They know which lawyers are aggressive and unafraid to file lawsuits, complete discovery, and take cases all the way to trial. They also know which lawyers rarely file suit or consistently settle for less once litigation begins.

The truth is simple: insurance companies calculate risk. A lawyer who files lawsuits, pushes discovery, and has a record of winning verdicts at trial poses a serious threat to them. That kind of lawyer can’t be ignored or lowballed because the insurance company knows there’s a real chance they’ll lose in court — and pay far more than they wanted to.

On the other hand, when an insurance adjuster recognizes that a lawyer almost never files suit, they know there’s little to worry about. Those cases are often given low settlement values from the start because the insurer knows the attorney will eventually take whatever is offered rather than risk the courtroom.

That’s why choosing the right lawyer makes such a difference. A strong, trial-ready attorney changes the entire negotiation dynamic. Suddenly, when the insurance company says, “This is our top offer,” that “final” number tends to move — often by a lot. They find more money because they know your lawyer is willing and capable of going the distance.
